A federal appeals court may soon require lawyers to certify that any filing prepared with generative AI was reviewed by a human before it hit the docket.

The Tenth Circuit proposed the rule after courts continued seeing AI-generated filings containing fabricated or inaccurate citations.

If adopted, it would be the first rule of its kind among the federal appeals courts.

And the consequences could be significant: monetary sanctions, disciplinary referrals, dismissed appeals, or filings being struck.

For lawyers, the message is getting harder to miss:

Use AI if you want. You still own every word it produces.
